To ask the Scottish Executive when it expects to make a decision regarding the proposed M876 slip road at Glenbervie.

I recognise the close interest which the member has shown in the Scottish Ministers'' decision into the proposed M876 slip road at Glenbervie following the public local inquiry.
The matter remains under active consideration and a decision will be announced as soon as possible. The report of the inquiry will be made available at that time.

To ask the Scottish Executive, further to the answer to question S3W-24186 by Stewart Stevenson on 4 June 2009, whether Larbert residents of properties affected by passing coal trains are eligible for compensation under Part 1 of the Land Compensation (Scotland) Act 1973.
Answer
Part 1 of the Land Compensation Act (Scotland) 1973 refers to compensation caused by the use of public works. The public works in this case is the Stirling-Alloa-Kincardine railway, which does not extend to Larbert. The railway at Larbert was operational prior to the opening of the Stirling-Alloa-Kincardine route. The Land Compensation (Scotland) Act 1973 also specifically excludes intensification of use as a result of the new railways works, such as the Stirling-Alloa-Kincardine Railway, as a ground for compensation under Section 9(7).

To ask the Scottish Executive what statutory powers are available to local authorities in preventing damage to the local environment.
Answer
There is a wide range of legislation and statutory powers available to local authorities to prevent and abate damage to the local environment.
This includes the Statutory Nuisance provisions within the Environmental Protection Act 1990 together with various EU obligations. The statutory planning system also has a role to play.

To ask the Scottish Executive what monitoring is undertaken to ensure that dentists minimise the charges that patients pay for NHS treatments.
Answer
The individual items of treatment which dentists can undertake under NHS general dental service arrangements and the associated patient charges are set down in the Statement of Dental Remuneration and are set by the Scottish Government.
The decision on individual patient treatment needs will be made by the dentist following a clinical assessment. Under their NHS terms of service, dentists should not provide care and treatment in excess of that which is necessary to secure and maintain oral health.

We have no current plans to introduce such a publicity campaign.
The leaflet HCS 2 A Quick Guide to Help with Health Costs provides information on charges and optical voucher values, including examples of NHS dental charges. Dentists providing NHS general dental services should display copies of this leaflet. It is also available at:

A Quick Guide to Help with Health Costs provides information on charges and optical voucher values, including the maximum patient charge for a single course of NHS dental treatment. Dentists providing NHS general dental services should display copies of this leaflet. It is also available at

We will issue guidance to dentists reminding them of the need to display copies of the HCS 2 leaflet.
