To ask the Scottish Executive what the status is of the agreement between it and the Regional Government of Tuscany, announced in its news release SEfm196/2003 of 19 June 2003, and, in particular, whether there are any penalties associated with non-compliance with any provision of the agreement.
Answer
The action plan, signed on 19 June 2003 by the First Minister and President Martini of Tuscany, builds on the Co-operation Agreement concluded with Tuscany in November 2002. The action plan sets out some of the specific areas on which Tuscany and Scotland will co-operate. Neither the action plan nor the agreement is a legally binding document and there are no penalties associated with non-compliance.

To ask the Scottish Executive what level of funding has been made available for broadband in each local enterprise area, expressed also per capita; whether any future funding has been, or will be, allocated for this purpose, and, if so, how much, and when, such funding will be available.
Answer
The supply of broadband is a commercial decision for operators. Our broadband strategy involves stimulating market demand and trialling new technologies. Funding is not therefore allocated on a local enterprise company/per capita basis. We are committed to helping extend broadband connectivity for every area of Scotland and will be bringing forward further initiatives in the coming months.

To ask the Scottish Executive, further to the answer to the first supplementary question to question S2O-229 by Malcolm Chisholm on 19 June 2003 (Official Report, c 968-969), on what issues it has sought legal advice in respect of interpreting the Scotland Act 1998 in order to assist negotiations with Her Majesty's Government about financial assistance for people infected with hepatitis C through contaminated blood and blood products while undergoing NHS treatment.
Answer
The substantive issue on which we have sought legal advice is whether the establishment of a scheme of ex-gratia payments of the kind I announced to the Health and Community Care Committee in January would be outside the devolved competence of Scottish ministers.

To ask the Scottish Executive what representations it will make regarding the European Commission's request for views on the proposal by the European Parliament that an additional 150 million be allocated as aid to fishing communities.
Answer
We have agreed a UK response to the Commission, which has issued on ...118 June 2003. First, this fund does not exist. The European Parliament has suggested its creation. However, the Commission would have to propose it, and the Council of Ministers endorse it.Second, such a fund would not increase public expenditure in Scotland because of the UK's public spending arrangements. So there is no benefit for Scottish fishing communities from this initiative.

To ask the Scottish Executive when it will establish an outreach training centre for dentists in Aberdeen; whether it will give details of any consultation exercise on the matter, including when any such exercise will be undertaken; whether it will provide details on any subsequent consultation on the need to develop the centre to a full dental school, as referred to in A Partnership for a Better Scotland, and how much funding is available for such projects.
Answer
In a Partnership for a Better Scotland we highlighted our commitment to the development of an outreach centre and the associated increase in dental students to occupy such a centre. This is at present part of an outline cost appraisal exercise being undertaken by officials within the Scottish Executive in both Health and in Enterprise, Transport and Lifelong Learning as the agreement could have implications for both departments.A dental hospital is a longer term option and could be disproportionately expensive. It is important that any consultation did not delay any initiatives. However, following discussions with key external agencies such as Grampian Health and universities associated with dental student teaching, we will publish our intentions.I have emphasised in a previous debate that shortages of dental workforce will not be solved by single issue initiatives but by a comprehensive change to the whole system which we have already started. One of our early successes has been the "golden hellos" which on initial assessment have assisted in recruitment of young graduates this year to Grampian and to dental practices in remoter parts of Scotland.

To ask the Scottish Executive whether the minutes, papers and reports of the meeting of the ad hoc group on European strategy established by the Cabinet on 18 June 2003 will be made public and, in particular, whether copies will be placed in the Scottish Parliament Information Centre and sent to relevant committees of the Parliament.
Answer
As indicated in the Guide to Collective Decision Making, a copy of which is available on the Scottish Executive website, the Executive operates on the basis of collective responsibility and does not disclose details of the internal processes through which decisions have been made. For that reason, the Executive does not normally publish minutes of ad hoc groups of ministers.
