The Scottish Government has no plans to make it compulsory to register children with a dentist. We have put in place a series of arrangements, via Health visitors and Childsmile dental health support workers, to encourage the registration of children with an NHS dentist.

As at March 2016, 93.7% of children in Scotland are registered with an NHS dentist.

Health visitors support families and act as a gateway to other services, including dentistry. The Universal Health Visiting Pathway for Scotland was published in October 2015: http://www.gov.scot/Publications/2015/10/9697 which presents a core home visiting programme to be offered to all families by health visitors. The core home visiting programme requires health visitors to introduce the Childsmile programme, and emphasise the importance of baby’s registration.

In addition, Childsmile dental health support workers assist our most vulnerable families register and attend the dentist.

To protect patient anonymity, payments made by the special health boards have been grouped together for the purposes of this table.

Fluctuations in the sums paid from year to year can be affected by the number of high value settlements made in any one year. These tend to relate to birth cases where the sums paid can be substantial.

It should also be noted that the year in which a payment is made does not necessarily reflect the year in which the corresponding incident took place. This is due to the fact that many claims take several years to conclude.

The Mental Health Tribunal for Scotland is an independent organisation which reports to Scottish Ministers and whose aim is to provide a responsive, accessible, independent and impartial service when making decisions on the compulsory care and treatment of people with mental disorders.

The Mental Health (Care & Treatment) (Scotland) Act 2003 specifies that a Compulsory Treatment Order (CTO) can only be granted by the Mental Health Tribunal Scotland (MHTS) and once an application has been received by a Mental Health Officer.

A CTO will expire after 6 months if it is not renewed, however a Responsible Medical Officer (RMO) can renew the order without variation and without referring it to MHTS. Renewal is for a period of 6 months and thereafter for periods of more than 12 months. Where a CTO has not been referred to MHTS, it must be reviewed by MHTS every 2 years.

On 29 July 2016 we published an engagement paper on our proposed framework and priorities to transform mental health in Scotland. The engagement paper states that, in addition to transforming mental health, progress on the priorities set out in the paper will also contribute to reducing death by suicide, and that we will reflect this in the final Mental Health Strategy. We will also build on these priorities in a separate Suicide Prevention Strategy which we will publish in 2017.

The Scottish Government does not hold the information requested however the Mental Welfare Commission is an independent organisation, which reports to Scottish Ministers and was set up to find out whether individual care and treatment is in line with the law and good practice.

As part of this role they produce statistics and analysis on the use of mental health and incapacity legislation. They have a statutory responsibility to monitor the use of the Mental Health Act, and their website contains statistical reports its use in 2014-15.
