Following a recent review, we will be publishing updated guidance on the operation of the Affordable Housing Supply Programme over the coming weeks so that Councils and Registered Social Landlords can apply for grant funding to enable them to purchase existing homes which are not for sale on the open market under the following circumstances.

Councils and Registered Social Landlords will be able to apply for grant funding to purchase homes with vacant possession where it can be demonstrated that the purchase meets a clear strategic purpose, and can clearly be seen to support the achievement of the priorities and objectives set out in a local authority’s Local Housing Strategy. Securing stock where there is a limited supply and limited development opportunities is an example of the type of situation where this might be deemed appropriate.

Councils and Registered Social Landlords will also be able to apply for grant funding to enable them to acquire properties from owner occupiers (particularly those in mixed tenure blocks) who cannot afford the required maintenance or refurbishment of their home, and would therefore wish to sell their home to a Council or Registered Social Landlord and become a tenant in the social rented sector. This will be permitted where is can be clearly demonstrated that:

• the purchase facilitates the consolidation of stock ownership for managing specific planned stock improvement/ refurbishment works, and supports the achievement of the priorities and objectives set out in a local authority’s Local Housing Strategy
• the local authority is unable to facilitate the planned works from local resources under discretionary power to assist
• the homeowner has received (a) advice about their financial situation from an FCA authorised independent financial adviser and (b) independent legal advice on the terms of the proposed sale and subsequent tenancy agreement
• the homeowner will employ a solicitor to act on their behalf with respect to the sale of their home, and
• the homeowner is not eligible for support under the Home Owners’ Support Fund.

The value of any property to be purchased in this situation must be in line with the terms of the Mortgage to Rent scheme. And the amount of money that a household can retain post sale will also mirror the terms of the Mortgage to Rent scheme.

Information relating to the number of homes receiving measures from Home Energy Efficiency Programme Scotland (HEEPS) schemes for the last five years has been lodged with the Scottish Parliament Information Centre (Bib. Number 63123).

Properties benefitting from an energy efficiency measure delivered as part of our Warmer Homes Scotland or Area Based Schemes will have received a survey. Properties benefitting from measures funded with the support of a Scottish Government loan or cashback will have been recommended for the measure in an Energy Performance Certificate.

For our other Home Energy Efficiency Programme Scotland schemes, we do not collect or collate separate information about the number of properties that may have benefitted from a survey.

We do not collect or collate information for all schemes about the value of the support provided by local authority area. The Scottish Government welcomes the publication of Wave 2 of the ‘RentBetter’ research programme. This research provides a valuable insight into the experiences of households living in, and landlords providing, rental properties in Scotland.

We will consider the findings as part of the evidence to inform policy development for the Year 2 Housing Bill and in finalising the Rented Sector Strategy.

The Heat in Buildings Strategy (7 October 2021), committed to introducing primary legislation in the current session of the Scottish Parliament that would set a regulatory framework for heat and energy efficiency, as a key action to meeting Scotland’s statutory climate change targets.

This strategy proposes to introduce minimum energy efficiency standards for private rented, owner-occupied and social housing. Regulations are proposed to be introduced that will require all properties to meet a minimum standard equivalent to EPC C by 2033.

Subject to consultation, the Scottish Government is proposing that compliance with the standard may be required at a variety of trigger points, including following the completion of a sale and after the change of a tenancy (for private rented sector properties), where installation of energy efficiency measures is technically-feasible and cost-effective.

The Scottish Government will consult publicly on these proposals within the coming year.

Buildings which are the subject of a conversion, as defined under building regulations, are already required to meet current building standards, to the extent this is reasonably practicable.

This year, the Scottish Government will commission independent research which will specify what fabric energy efficiency levels are necessary in existing homes for the cost effective installation of different zero direct emission heating sources, in different archetypes of domestic properties. The outcomes from this research will inform our proposals for energy efficiency regulations, ahead of a public consultation in the coming year.

Improvements to Building Regulations from October this year, (which apply to new buildings and new building work), will improve fabric standards to reduce space heating demand. They will also deliver new heating systems which operate at lower temperatures, compatible with the efficient operation of zero direct emissions heating sources.

Energy Performance Certificates (EPCs) provide an assessment of the modelled energy performance of buildings. The Scottish Government recognises that the information presented on EPCs needs to be reformed in line with the recommendations of the Climate Change Committee. We consulted last year on reforming EPCs to introduce a new metric for energy efficiency. This is intended to ensure that the EPC metrics align with our net zero target.

Following our consultation, we are commissioning research to understand the implications of several options for the new energy efficiency metric. These options include an energy demand metric which would be based on the dwelling’s space heating and cooling demand. As set out in our consultation, we intend that EPCs will present the new energy efficiency metric alongside the current running cost and carbon emissions metrics.

Single Building Assessment applicants are supported through the process to complete the application form and commission professional services ahead of receiving the final survey report. 15 pilot blocks are within the Application Phase. 10 pilot blocks are within the Delivery Phase. One additional block is existing within the new approach where we direct commission those professional services on behalf of a building.

Within our pilot model, applicants are required to obtain up to three quotes to participate in the Single Building Assessment programme.

As we move through the next phase of this programme of work, where we directly procure assessors for buildings receiving Single Building Assessments, we will compile a list of the appropriately qualified professionals contracted to carry out this work.
